Terms governing your use of the platform

By registering on or accessing the MITRA (NMM) / NPST platform you agree to be bound by the terms set out below. Please read them carefully before using the platform.

Privacy and Data Protection

The platform may collect, process, store, and use personal information such as names, designation, institution details, contact information, and other data required for registration, authentication, mentoring activities, professional development, analytics, and programme implementation. Such information shall be handled in accordance with applicable laws, Government of India policies, and the platform’s Privacy Policy. Reasonable administrative, technical, and security measures shall be implemented to safeguard user information from unauthorised access, disclosure, alteration, or destruction.

User-Generated Content

Users may upload or share content including profile information, comments, feedback, discussion posts, documents, presentations, mentoring resources, grievances, and other materials. Users shall be solely responsible for the content submitted by them and shall ensure that such content does not violate any applicable law, intellectual property rights, privacy rights, or ethical standards. The platform reserves the right to review, moderate, restrict, or remove any content deemed inappropriate, unlawful, misleading, offensive, or inconsistent with the objectives of the platform.

Intellectual Property Rights

All content, materials, logos, designs, and resources available on this platform are the property of the Ministry of Education, Government of India, and/or NCTE, unless otherwise stated. Users shall not reproduce, modify, distribute, or commercially use any content without prior written permission from the competent authority.

Platform Usage and Conduct

Personal data shall be processed only for lawful purposes connected with registration, authentication, mentoring activities, programme implementation, analytics, grievance redressal, platform administration, and compliance with applicable legal obligations, in accordance with the Digital Personal Data Protection Act, 2023 and other applicable laws.

All users, including mentors, mentees, institutions, and other stakeholders, shall be responsible for ensuring that the information, credentials, qualifications, documents, representations, and other particulars furnished by them on the Platform are true, accurate, complete, and up to date. Any person providing false, misleading, inaccurate, fraudulent, or fabricated information shall be solely liable for the consequences arising therefrom, and the Platform reserves the right to suspend or terminate access, remove content, and initiate such administrative, civil, or legal action as may be deemed appropriate under applicable law.

Users shall have the right to request correction, updation, completion, or erasure of their personal data, subject to applicable laws and operational requirements. Such requests may be submitted through the designated grievance redressal mechanism of the Platform.

The Platform, NCTE, the Ministry of Education, and associated agencies shall not be liable for any interruption, delay, loss of data, failure of performance, or disruption of services arising from events beyond their reasonable control, including but not limited to cyber-attacks, communication failures, internet disruptions, power outages, natural disasters, pandemics, governmental actions, judicial orders, strikes, or other force majeure events.

Monitoring and Audit

The platform reserves the right to monitor system usage, maintain activity logs, conduct audits, and generate reports for security, operational, administrative, research, and policy purposes. Such monitoring shall be undertaken in accordance with applicable laws and government guidelines.

Grievance Redressal

Users may submit grievances, complaints, or feedback through the designated grievance redressal mechanism available on the platform. The competent authority shall make reasonable efforts to review and address grievances within a reasonable timeframe. Submission of a grievance does not guarantee a particular outcome, and decisions taken by the competent authority shall be final and binding.

Third-Party Services

The platform may integrate with third-party services, including authentication systems, communication channels, cloud services, video conferencing tools, messaging services, and other government-approved applications. The platform shall not be liable for interruptions, limitations, or issues arising from such third-party services.

Limitation of Liability

NCTE, the Ministry of Education, Government of India, implementation agencies, technology partners, and associated organisations shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of, inability to use, or reliance upon the platform, its services, or its content.

Modification of Services

The platform reserves the right to modify, suspend, discontinue, enhance, or replace any feature, service, content, functionality, or policy at any time without prior notice in the interest of operational efficiency, security, policy compliance, or programme requirements.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to the use of the platform shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

This platform has been developed to support the implementation of the National Education Policy (NEP) 2020 and is intended solely for educational, informational, and professional development purposes.

While reasonable efforts are made to ensure the accuracy and reliability of the information provided, NCTE, as a statutory body of the Ministry of Education, Government of India, and associated implementing agencies make no warranties regarding the completeness, accuracy, or suitability of the content. The views, opinions, and materials shared by mentors, mentees, school heads, institutions, or other users are their own and do not necessarily reflect the views of NCTE or the Ministry of Education, Government of India.

Any opinion, guidance, recommendation, mentoring input, comment, or material shared by mentors, mentees, teachers, institutions, school heads, or other users is personal in nature and shall not be construed as official policy, legal advice, regulatory guidance, or binding directions of NCTE, the Ministry of Education, or any Government authority.

In the event of any inconsistency or conflict between any information available on the Platform and any applicable law, regulation, notification, circular, office memorandum, policy decision, or order issued by a competent authority, the latter shall prevail and be binding.

For any grievance relating to privacy, personal data, or data protection concerns, users may contact the designated Grievance Officer/Nodal Officer at the details notified on the Platform. By accessing or using this platform, users acknowledge and agree to the terms of this Disclaimer.

Acceptance of Terms

By registering on, accessing, or using the MITRA (NMM) or NPST platform, users acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions and any amendments issued from time to time by the competent authority.
